Abstract

ABSTRAK
Urgensi penelitian ini antara lain pengaturan perkara Desersi secara In Absensia meruju pada Pasal 143 UU Peradilan Militer yang pada praktiknya masih ada perkara yang diputus dalam jangka waktu dibawah 6 (enam) bulan guna menanggulangi tunggakan perkara. Dalam Penelitian ini menggunakan jenis penelitian yuridis normatif yang merupakan suatu cara yang sistematis dalam melakukan sebuah penelitian berupa produk perilaku hukum. Penelitian ini menggunakan metode jenis penelitian normatif. Penelitian normatif diolah menggunakan teknik pengolahan data Triangulasi dan dianalisis secara kualitatif. Pengaturan hukum terhadap penyelesaian perkara Desersi secara In Absensia dikaitkan dengan Pasal 143 UU Peradilan Militer yang memiliki jangka waktu paling lama 6 (enam) bulan berturut-turut dan sudah dilakukan pemanggilan 3 (tiga) kali secara sah. Pemeriksaan perkara Desersi secara secara In Absensia yang dilakukan tidak sesuai dengan ketentuan. Alasan apapun dan pertimbangannya, tidak dibenarkan karena bertentangan dengan persyaratan formal yang dirumuskan dalam UU Peradilan Militer. Penyelesaian perkara Desersi secara In Absensia pada Peradilan Militer dalam perspektif kepastian, keadilan dan kepastian hukum di Pengadilan Militer harus mengacu pada Pasal 143 UU Peradilan Militer yang jangka waktu/prosesnya paling lama selama 6 (enam) bulan. Terlepas dari Perundang-Undangan lain, sejalan dengan ketentuan Lex specialis derogat legi generali, maka kedua peraturan Perundang-Undangan tersebut harus dikesampingkan dan mengutamakan UU Peradilan Militer.

ABSTRACT
The urgency of this research includes the arrangement of cases of desertion in absentia referring to Article 143 of the Law on Military Justice where in practice there are still cases that are terminated within a period of under 6 (six) months in order to deal with arrears in cases. This research uses a normative juridical research type which is a systematic way of conducting research in the form of legal behavior products. This study uses a normative research type method obtained through a literature study. Data processing was carried out using triangulation data processing techniques. After the data is collected, the data is analyzed qualitatively in the form of words and language in a special context that is natural and utilizes various natural methods. Legal arrangements for the settlement of cases of desertion in absentia are associated with Article 143 of the Law on Military Justice which has a maximum period of 6 (six) consecutive months and has been legally summoned 3 (three) times. Examination of cases of desertion in absence which was carried out did not comply with the provisions. Whatever the reasons and considerations, they are not justified because they conflict with the formal requirements formulated in the Law on Military Justice. Settlement of cases of desertion in absentia at military courts in the perspective of certainty, justice and legal certainty at military courts must refer to Article 143 of the Military Court Law, which has a maximum period/process of 6 (six) months. Regardless of other laws, in line with the provisions of Lex specialis derogat legi generali, the two laws and regulations must be set aside and prioritize the Law on Military Justice.
